Agreement to Terms
By accessing or using Cardlist ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
Description of Service
Cardlist is a collection tracker for trading card collectors, with selling built in as an optional extra. The Service allows you to:
- Manage your trading card collection and track what it is worth
- Keep wishlists of the cards you are still after
- Build decks and track set completion
- Publish a public profile with showcases, decks, and wishlists
- Follow other collectors and post to the activity feed
- Access card database and pricing information
- Create and publish listings to eBay
- Track orders and sales
We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
Account Terms
- You must be at least 13 years old to create an account (see Age and Children below)
- Selling features connect to eBay and require you to meet eBay's own age requirement (18+)
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use
- One person or entity may not maintain more than one account
Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Violate any laws in your jurisdiction
- Infringe on intellectual property rights
- Transmit malware or malicious code
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Use automated systems to access the Service without permission
- Resell or redistribute the Service without authorization
- List counterfeit or stolen goods
Community Content and Moderation
Cardlist has social features: public profiles, showcases, decks, wishlists, and an activity feed. Content you make public is covered by our Community Guidelines, which set out what is and is not allowed.
Anyone can report content, whether or not they have an account. We review every report and may dismiss it, warn the user, remove the content, or suspend or ban the account, depending on how serious the issue is.
If we remove content you posted, we will send you a statement of reasons: what we removed, the rule or legal ground it broke, and the facts we relied on. Removed content stops showing to other users but remains visible to you with a notice explaining that it was removed.
Appeals
You can appeal any moderation decision by replying to the removal notice we email you, or by writing to [email protected] with your username and what you are appealing. A person reviews every appeal.
Age and Children
You must be at least 13 years old to create an account. We ask for your date of birth at sign-up to check this. We do not store your date of birth; we only record that you passed the check.
Cardlist is not directed at children under 13, and we do not knowingly collect personal information from them. If we find a credible signal that an account holder is under 13, we suspend and delete the account. If you believe a child under 13 has created an account, contact us at [email protected].
eBay Integration
When you connect your eBay account to Cardlist:
- You authorize us to access your eBay seller account via the eBay API
- You remain responsible for complying with eBay's policies and terms
- Listings created through Cardlist are subject to eBay's fees and policies
- We are not responsible for actions taken by eBay on your account
- You can disconnect your eBay account at any time
Cardlist is not affiliated with or endorsed by eBay Inc.
Subscriptions and Payments
Free and Paid Plans
Cardlist offers both free and paid subscription plans. Paid plans provide additional features and higher usage limits as described on our pricing page.
Billing
- Paid subscriptions are billed monthly in advance
- Payments are processed securely through Stripe
- Prices are in USD unless otherwise stated
- You authorize us to charge your payment method on a recurring basis
Cancellation
- You may cancel your subscription at any time
- Cancellation takes effect at the end of the current billing period
- No refunds are provided for partial months
- Upon cancellation, your account reverts to the free plan
Price Changes
We may change subscription prices with 30 days notice. Continued use of the Service after price changes constitutes acceptance of the new prices.
Intellectual Property
The Service, including its original content, features, and functionality, is owned by Cardlist and is protected by intellectual property laws.
Trading card names, images, and related content are the property of their respective owners (The Pokemon Company, Wizards of the Coast, Konami, Bandai, etc.). Cardlist uses this content for informational purposes.
You retain ownership of any content you create or upload to the Service, including collection data, listing descriptions, and images.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted or error-free
- Card pricing data is accurate or current
- The Service will meet your specific requirements
- Any errors in the Service will be corrected
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDLIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Cardlist and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.
Termination
We may terminate or suspend your account immediately, without prior notice, for any reason, including if you breach these Terms.
Upon termination:
- Your right to use the Service will immediately cease
- We may delete your account and data
- Provisions that should survive termination will remain in effect
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or by posting a notice on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.
